These Terms of Use (the “Terms”) govern the access to and use of the VacationPoland mobile application (the “App”) provided by Aliaksandra Verchanka (the “Service Provider”). By accessing and using the App, users agree to comply with these Terms and the Privacy Policy. If you do not agree with these Terms, please do not use the App.
1.1 Service Provider: The owner and operator of the Application is Aliaksandra Verchanka, located at Bociana St. 6c/15, 31-231 Kraków, Poland. Email: vacationpolandpl@gmail.com.
1.2 User: A “User” refers to any person who has downloaded and is actively using the App on a compatible device, and has accepted the Terms and Privacy Policy.
1.3 Application: The App, "VacationPoland," is a mobile application designed to assist users in exploring cities by providing them with navigation, descriptions, and access to tourist destinations, including museums, restaurants, and other points of interest.
1.4 Service Features: The App includes features such as location-based navigation, customized tours, audio guides, and the ability to explore city maps with points of interest (POIs). These services are available through the FREE PLAN, PREMIUM PLAN (monthly subscription), and UNLIMITED PLAN (annual subscription).
1.5 Eligibility: To use the App, the User must be at least 18 years of age or the age of majority in the jurisdiction in which they reside.
1.6 Modifications to the Terms: The Service Provider reserves the right to modify or amend these Terms at any time. Any changes will be communicated via the App, and continued use of the App after such changes will constitute acceptance of the revised Terms.
2.1 Application: The VacationPoland mobile application is available for download on the App Store or Google Play.
2.2 Service Provider: The owner and operator of the Application, Aliaksandra Verchanka, providing the services and content in the Application.
2.3 User: A person who has downloaded and is using the Application.
2.4 Subscription:
FREE PLAN: Provides limited access to the content and features of the application with no time limitations.
PREMIUM PLAN (monthly subscription): Full access to all features and content of the Application for one month.
UNLIMITED PLAN (annual subscription): Full access to all features and content of the Application for one year.
2.5 Content: The content of the Application includes maps, Points of Interest (POI), audio guides, tours, and recommendations for museums, restaurants, and tourist attractions.
2.6 POI (Point of Interest): Locations such as museums, monuments, restaurants, and attractions that can be visited or explored within the application.
2.7 Tour: A route with an audio guide and text description prepared by the Service Provider. It is automatically determined when the user navigates to the corresponding section of the Application and selects a city.
2.8 City: A city available in the Application in Poland for which the Service Provider has developed original tours and POIs.
3.1 App Availability: The App is available for download from the App Store or Google Play for compatible mobile devices running iOS or Android. The App may be available only in certain geographic regions, and its availability is subject to local laws and regulations.

FREE PLAN: Provides access to limited content and features without a time limitation
PREMIUM PLAN (monthly): Provides access to all features for one month
UNLIMITED PLAN (annual): Provides access to all features for one year, including updates and future content
4.2 Subscription Process: Subscriptions are paid through the App Store or Google Play Store using the User’s linked payment method. The payment will be processed by the platform and subject to the platform’s policies and fees.
4.3 Payment Confirmation: Once payment is successfully processed, the User will receive immediate access to the content and features of the App, based on their subscription plan.
4.4 Cancellations and Renewals: Users can cancel their subscription at any time, but cancellation will take effect after the current billing period ends. The subscription will automatically renew unless canceled by the User before the renewal date.
4.5 Refunds: All purchases are final. Refunds may not be issued except where required by applicable consumer protection laws.
5.1 Content Usage: By subscribing to the App, Users are granted a non-exclusive, non-transferable right to use the content for personal, non-commercial purposes. The content provided through the App cannot be copied, distributed, or modified without prior written consent from the Service Provider.
5.2 User Contributions: Users may have the opportunity to contribute content to the App, such as reviews or recommendations. By submitting content, Users grant the Service Provider a worldwide, royalty-free license to use, modify, and distribute the content.
5.3 User Data: The User's personal data will be processed in accordance with the Privacy Policy. The User agrees to provide accurate personal information and to maintain its accuracy for the duration of the subscription.
5.4 Intellectual Property: All content in the App, including but not limited to, text, graphics, logos, and software, is protected by copyright law and is the property of the Service Provider or its licensors.
6.1 Service Provider’s Responsibilities: The Service Provider will make reasonable efforts to ensure the proper functioning of the App. However, the Service Provider does not guarantee uninterrupted access or error-free operation of the App.
6.2 User Responsibilities: Users are responsible for the security of their mobile devices and for keeping their login credentials confidential. The Service Provider is not responsible for unauthorized access to the User’s account resulting from the User's failure to secure their device or account.
6.3 Limitation of Liability: The Service Provider is not liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the App. The liability of the Service Provider is limited to the amount paid by the User for the subscription, if applicable.
7.1 Data Processing: The Service Provider processes User data as described in the Privacy Policy. By using the App, the User consents to the collection and use of personal data in accordance with the Privacy Policy.
8.1 Termination by User: Users may terminate their subscription at any time through their account settings in the App or by contacting the Service Provider directly. Termination will take effect at the end of the current billing period.
8.2 Termination by Service Provider: The Service Provider reserves the right to suspend or terminate the User's access to the App in case of violation of these Terms or other unlawful activity.
8.3 Effect of Termination: Upon termination, the User’s access to paid content will be revoked, and the User will lose the right to access previously purchased content.
9.1 Complaints: Users may submit complaints regarding the App or subscription services by contacting the Service Provider via email at vacationpolandpl@gmail.com. Complaints will be reviewed within a reasonable time.
9.2 Disputes: In case of a dispute, the Service Provider will attempt to resolve the issue amicably. If resolution is not possible, the matter will be taken to the relevant court in Kraków, Poland.
10.1 Governing Law: These Terms are governed by the laws of Poland.
10.2 Amendments: The Service Provider reserves the right to amend these Terms at any time. The updated Terms will be made available within the App.
10.3 Severability: If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will continue in full force and effect.
